1. Acceptance of these Terms
By creating an account, uploading content, purchasing credits or otherwise using e57.gs (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Service is operated by L2 Labs under the e57.gs name (“e57.gs”, “we”, “us” or “our”). You must be legally able to enter into this agreement. If you use the Service for an organization, you represent that you are authorized to bind it.
2. The Service
e57.gs provides automated and assisted tools for processing point clouds, scan data and related 3D files into formats such as Gaussian Splats, PLY, SPLAT, OBJ, STL, GLB or other outputs made available from time to time.
Features, supported formats, processing methods, limits and availability may change. We may reject, pause or stop a conversion when a file is unsupported, unsafe, corrupted, incomplete, unusually large or cannot be processed with available resources.
3. Accounts and security
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account and for notifying us promptly of suspected unauthorized access. You may not share access in a way that circumvents account, project, usage or payment restrictions.
4. Your files and content
You retain ownership of files and content you submit. You grant us a limited, non-exclusive license to host, copy, transmit, transform and process that content solely as reasonably necessary to operate, secure, troubleshoot and provide the Service.
You represent that you have all rights, permissions and lawful bases needed to upload and process the content. Do not upload content that is unlawful, infringes third-party rights, contains malware, exposes confidential information without authorization, or includes personal data you are not permitted to process.
5. Conversion results and user verification
Conversion results are computational outputs and may contain errors, omissions, distortions, artifacts, missing geometry, incorrect scale, orientation, color, topology or measurements.
We do not guarantee that any upload will process successfully or that an output will be accurate, complete, watertight, dimensionally faithful, compatible with any software, suitable for a particular purpose, or free from defects. Source quality, scan coverage, noise, scan alignment and third-party software can materially affect results.
You must inspect, test and independently validate every output before relying on it. Results are not certified survey data, engineering calculations, construction documents, safety analysis, manufacturing instructions or professional advice. Do not use the Service as the sole basis for safety-critical, structural, legal, surveying, medical, manufacturing or financial decisions.
6. Pricing, credits and payments
Prices and included usage are shown at checkout or in the Service. Payments are processed by third-party payment providers. A sufficient credit balance is required to start an E57 conversion, but a credit is deducted only after a successful conversion. Failed conversions are not charged. Credits have no cash value, are not transferable and may be subject to the rules displayed when purchased.
Except where required by law, completed processing and consumed credits are not refundable. Nothing in these Terms limits mandatory cancellation, refund or consumer rights that apply to you.
7. Storage, downloads and sharing
The Service is not a permanent archive. Files, intermediate data, outputs and logs may be removed under the retention terms shown in the Service, after account closure, or when reasonably required for security, capacity or legal compliance. Keep your own copies of important source files and permitted outputs.
Anyone with a public or share link may be able to access the associated content. You are responsible for deciding what to share, who receives a link and whether shared content contains sensitive or restricted information.
8. Acceptable use
You may not use the Service to:
- violate law, privacy, intellectual-property or contractual rights;
- upload malicious code or attempt unauthorized access;
- interfere with, overload, scrape or reverse engineer the Service except where law permits;
- evade technical limits, security controls, billing or access restrictions;
- process content that creates an unreasonable risk to people, property or systems.
9. Third-party services
The Service relies on third-party hosting, storage, processing, authentication, payment, analytics and communication providers. Their services may be unavailable, changed or subject to separate terms. We are not responsible for third-party systems beyond the responsibility that applicable law requires us to retain.
10. Availability and changes
We do not promise uninterrupted or error-free operation. Maintenance, demand, hardware availability, network failures and third-party outages may delay or prevent processing. We may modify, suspend or discontinue features, but this does not remove rights that mandatory law gives you for paid services.
11. Disclaimer of warranties
To the maximum extent permitted by law, the Service and all outputs are provided “as is” and “as available”. We disclaim all express, implied and statutory warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement and any warranty arising from course of dealing or usage of trade.
Some jurisdictions do not allow certain exclusions. In that case, the exclusions apply only to the maximum extent legally permitted.
12. Limitation of liability
To the maximum extent permitted by law, e57.gs and its operators, affiliates, suppliers and personnel will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages; loss of profits, revenue, business, data or goodwill; the cost of substitute services; or decisions made from inaccurate or incomplete outputs.
To the maximum extent permitted by law, our total aggregate liability arising from the Service will not exceed the greater of EUR 100 or the amount you paid to e57.gs during the 12 months immediately before the event giving rise to the claim.
These limits do not exclude liability that cannot legally be excluded, including liability for fraud, willful misconduct, death or personal injury caused by negligence, or mandatory consumer rights.
13. Responsibility for claims
To the extent permitted by law, if you use the Service for business purposes, you will defend and indemnify e57.gs against third-party claims arising from your content, your unlawful use of the Service, or your violation of another person’s rights. This section does not apply where prohibited by mandatory consumer law.
14. Suspension and termination
You may stop using the Service at any time. We may restrict or terminate access for material breach, unlawful activity, security risk, non-payment or conduct that threatens the Service or others. Where reasonably possible, we will provide notice and an opportunity to resolve the issue.
15. General terms
If part of these Terms is unenforceable, the remainder remains effective. Failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, reorganization or sale of the Service.
Applicable law and courts with lawful jurisdiction govern disputes. Mandatory consumer protections, including any right to bring a claim in your home jurisdiction, remain unaffected.
16. Changes and contact
We may update these Terms. Material changes will be communicated through the Service or by other reasonable means. Continued use after an update takes effect constitutes acceptance where permitted by law.
